1. Introduction

Welcome to Mauveine (www.mauveinewellness.com), operated as a sole proprietorship in Nevada (Reno/Washoe County). These Terms and Conditions (“Terms”) govern your access to and use of the Mauveine website, products, and services. By accessing or using our website and purchasing our products, you agree to be bound by these Terms. Please read them carefully.

Our products are intended for individuals who are 18 years of age or older. By accessing our website and purchasing products, you represent and warrant that you are at least 18 years old. Mauveine does not knowingly collect personal information from individuals under 18. If we become aware that a person under 18 has provided us with personal information, we will take steps to delete such information.

3.1. Curator and Retailer Disclaimer

Mauveine is a curator and retailer of intimate wellness products. Mauveine is NOT a manufacturer. All product safety certifications, testing, quality assurance, and compliance with applicable safety standards are the sole responsibility of the original manufacturer and/or sourcing wholesaler. Mauveine does not independently test, certify, or guarantee the safety, efficacy, or quality of any individual product beyond selecting items from reputable suppliers. By purchasing from Mauveine, you acknowledge and agree that any claims related to product defects, manufacturing errors, or safety failures are the responsibility of the original manufacturer and not Mauveine.

3.2. Disclaimer of Liability for Improper Use

Mauveine is NOT liable for any damages, injuries, or adverse effects resulting from the improper use of its products. It is the customer’s sole responsibility to understand and follow all product instructions, warnings, and guidelines provided with each product. Failure to do so may result in injury or other undesirable outcomes, for which Mauveine assumes no responsibility.

3.3. Requirement to Read Product Instructions

Customers are required to read all product instructions, warnings, and safety information provided with each product before use. This includes, but is not limited to, instructions for the vibrator (Maia Bari), water-based lubricant (Bodyotics), massage balm (Second Life Candles), self-love tea light spell candle (You Are Uniquely Magic), and the educational booklet included in the “In Bloom Kit.”

3.4. External/Personal Use and Non-Medical Disclaimer

All products sold by Mauveine are intended for external and personal use only and are non-medical devices. They are designed for wellness and self-care purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Mauveine makes no medical claims regarding its products.

3.5. Product Safety and Allergies/Sensitivities

Mauveine endeavors to provide products made from body-safe materials. However, customers assume full responsibility for checking product ingredients and conducting patch tests before full use, especially if they have known allergies, sensitivities, or skin conditions. Mauveine is not liable for allergic reactions or sensitivities experienced by customers. If irritation occurs, discontinue use immediately and consult a healthcare professional.

All official business communications, including but not limited to order inquiries, refund requests, product questions, complaints, and customer support, must be directed exclusively to hello@mauveinewellness.com. Mauveine is not responsible for any communications sent through other channels, including but not limited to social media platforms (Instagram, TikTok, Facebook, etc.), direct messages, third-party messaging services, comments, or any other unofficial communication method. Any communication not sent to hello@mauveinewellness.com will not be considered an official inquiry and Mauveine is under no obligation to respond to or act upon such communications.

All sales are final. No exceptions. Due to the intimate and hygienic nature of our products, Mauveine is unable to accept returns, exchanges, or issue refunds under any circumstances. This includes, but is not limited to:

• Lubricants and water-based products

• Oils and massage balms

• Toy cleaners

• Vibrators and intimate devices

• Candles

• Any opened or sealed product

No returns, refunds, or exchanges will be processed regardless of reason. By completing your purchase, you acknowledge and agree to this policy.

To the fullest extent permitted by law, Mauveine, as a sole proprietorship, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the products; (b) any conduct or content of any third party on the products; (c) any content obtained from the products; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

All products and services provided by Mauveine are sold “as is” and “as available,” without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Mauveine does not warrant that the products will be uninterrupted, secure, or error-free.

All content on the Mauveine website, including but not limited to text, graphics, logos, images, product descriptions, and the educational booklet, is the intellectual property of Mauveine and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without the express written permission of Mauveine.

Mauveine strives to process and ship orders promptly. However, we are not responsible for delays in shipping or delivery caused by third-party carriers, customs, or other factors beyond our reasonable control. Shipping times are estimates and not guaranteed. Products are shipped in discreet packaging to ensure customer privacy.

You agree to indemnify, defend, and hold harmless Mauveine, its owner, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms.

These Terms shall be governed and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within Washoe County, Nevada, for the purpose of litigating all such claims or disputes.

Mauveine reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our products after those revisions become effective, you agree to be bound by the revised terms.
